PALM BEACH GARDENS, Fla., Aug. 27, 2026 (GLOBE NEWSWIRE) — Attorney Sean C. Domnick of Rafferty Domnick Cunningham & Yaffa is examining the sweeping child-safety measures Meta has agreed to implement on Facebook and Instagram as part of its proposed multistate settlement, arguing that the mandated changes to the platforms themselves deserve as much attention as the settlement’s multibillion-dollar price tag.
In a new analysis published by Rafferty Domnick Cunningham & Yaffa, Domnick focuses on requirements that would change how children interact with two of the world’s largest social media platforms.
“The extraordinary dollar figure is going to dominate the headlines, but the product changes may ultimately be the more important part of this settlement,” Domnick said. “For years, families have effectively been told that managing children’s social media use is primarily their responsibility. These requirements recognize that the companies designing the platforms have responsibilities as well.”
Under the proposed settlement, Meta would implement a combined two-hour daily limit for children using Instagram and Facebook, along with mandatory “Productive Pauses” intended to interrupt prolonged scrolling. The company would also restrict children’s access overnight and eliminate push notifications during much of the school day.
Additional requirements address age assurance, parental controls and children’s exposure to potentially harmful content, including material involving bullying, eating disorders, suicide and self-harm. The settlement also restricts certain social-comparison features, including beauty filters and visible like counts for young users.
Domnick’s analysis argues that these provisions represent an important shift in the child-safety debate because they address the design of social media products rather than relying exclusively on warnings, parental supervision or individual self-control.
“If you believe a particular feature is contributing to harmful or compulsive behavior, one response is to tell children not to use it,” Domnick said. “Another is to ask why the feature needs to operate that way for children in the first place.”
Domnick also points to the settlement’s independent auditing requirements as an especially significant provision. Implementation and effectiveness of the protections will be regularly assessed by an independent auditor and participating states.
“The question a year from now should not simply be whether these features were installed,” Domnick said. “We should be asking whether they worked. Did overnight use fall? Did prolonged scrolling decrease? Are age controls actually identifying minors? Are children encountering less harmful material? Those outcomes matter.”
Domnick further notes that the agreement could influence safety standards beyond Meta because its terms contemplate additional changes if other major social media platforms adopt comparable protections.
The proposed settlement remains subject to court approval.
